I’m not a lawyer. You don’t seem like the “play it safe” type. That said, there would be a way to reframe your opening paragraph more in terms of your curiosity over how the developers intend to follow through on their selling points, given the issues you’ve identified. You could come across as striving to be helpful to them, rather than being bent on puncturing their hype balloon. -

Attribute aggressively (“according to…”, “appears to…”, “based on…”)
Separate facts from conclusions (facts first, opinion after)
Avoid stating intent as fact (“intended to”, “designed to”), frame it as inference
